Important

By accessing or using the Tutorat Pro platform, you agree to be bound by these Terms of Use. If you do not agree with any part of these terms, you must not use the platform.

These Terms of Use ("Terms") govern your access to and use of the Tutorat Pro platform, including all related websites, applications, and services ("the Platform"). Please read them carefully before using our services.

1. Definitions

  • "Platform": the Tutorat Pro web application and all associated services, accessible at tutorplanner.com and its subdomains.
  • "User": any person who accesses or uses the Platform, including administrators, tutors, and clients.
  • "Administrator": a User with management and administrative privileges on the Platform.
  • "Tutor": a User who provides tutoring services through the Platform.
  • "Client": a User who retains tutoring services through the Platform for themselves or a student.
  • "Student": the individual receiving tutoring services.
  • "Content": all information, text, data, materials, and documents available on the Platform.
  • "Company": Tutorat Pro, a company headquartered in Montreal, Quebec, Canada.

2. Registration and Account

To access certain features of the Platform, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information to keep it accurate and complete
  • Maintain the security and confidentiality of your login credentials
  • Accept responsibility for all activities that occur under your account
  • Immediately notify us of any unauthorized use of your account

We reserve the right to suspend or terminate any account that we reasonably believe has been used in violation of these Terms or for any fraudulent or illegal activity.

3. Authorized Use

The Platform is provided for the following authorized purposes:

  • Managing and scheduling tutoring sessions
  • Communication between tutors, clients, and administrators
  • Invoicing, billing, and payment processing
  • Tracking student progress and academic follow-up
  • Managing tutor profiles, availability, and qualifications
  • Generating reports and analytics related to tutoring services

Any use of the Platform beyond its intended purpose is strictly prohibited.

4. Prohibited Uses

You agree not to use the Platform to:

  • Violate any applicable local, provincial, national, or international law or regulation
  • Transmit viruses, malware, or any other harmful code
  • Attempt to gain unauthorized access to any systems or networks connected to the Platform
  • Collect or harvest personal information of other Users without their consent
  • Use the Platform for any purpose other than its intended tutoring management functions
  • Impersonate another person or entity, or misrepresent your affiliation with any person or entity
  • Interfere with or disrupt the integrity or performance of the Platform
  • Circumvent, disable, or otherwise interfere with any security-related features
  • Use automated systems (bots, scrapers) to access the Platform without prior written consent

5. Pricing and Payment

The use of the Platform is subject to the pricing terms agreed upon between you and Tutorat Pro. The following conditions apply:

  • Rates for tutoring services are set by the Company and communicated to Users
  • Invoices are generated by the Platform and must be paid within the timeframe specified
  • Payments are processed securely through our payment provider (Stripe)
  • Late payments may be subject to interest charges as permitted by applicable law
  • Prepaid packages are subject to specific terms as outlined at the time of purchase
  • The Company reserves the right to modify pricing with reasonable advance notice

All amounts are in Canadian dollars (CAD) unless otherwise specified. Applicable taxes will be added to all amounts.

6. Termination

Either party may terminate the use of the Platform under the following conditions:

  • By the User: you may deactivate your account at any time by contacting us. Outstanding balances remain due.
  • By the Company: we may suspend or terminate your access immediately if you violate these Terms or engage in conduct harmful to other Users or the Platform.
  • Effect of termination: upon termination, your right to access the Platform ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

Sections related to intellectual property, limitation of liability, and governing law survive the termination of these Terms.

7. Intellectual Property

All content, features, and functionality of the Platform — including but not limited to text, graphics, logos, icons, software, and the overall design — are the exclusive property of Tutorat Pro or its licensors and are protected by Canadian and international intellectual property laws.

  • You may not copy, modify, distribute, or create derivative works based on the Platform without prior written consent
  • The Tutorat Pro name, logo, and all related trademarks are the property of the Company
  • Data you enter into the Platform remains your property, subject to our license to use it for providing the services

8. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Platform is provided "as is" and "as available" without warranties of any kind, whether express or implied
  • We do not guarantee that the Platform will be uninterrupted, error-free, or free of harmful components
  • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform
  • Our total liability for any claim arising from or related to these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim
  • We are not responsible for the quality of tutoring services provided by tutors using the Platform

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to its conflict of law provisions.

Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the judicial district of Montreal, Quebec.

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

These Terms constitute the entire agreement between you and Tutorat Pro regarding the use of the Platform and supersede all prior agreements and understandings, whether written or oral.
